Black Love LLC. DBA Black Couple Getaways Liability Waiver Form for The NYE Cruise 2024 and The Smokey Mountain Getaway held February 21-24 of 2025.

The “Terms and Conditions” within this agreement is subject to be updated at any point by The Black Love LLC’s (D.B.A. as BLACK COUPLE GETAWAYS) discretion and will be sent to every client registered for a Getaway and or event with BLACK COUPLE GETAWAYS.

GENERAL INFORMATION, RESPONSIBILITIES AND CONDITIONS PLEASE READ THE FOLLOWING CAREFULLY. DO NOT MAKE ANY PAYMENTS UNTIL YOU HAVE READ THE FOLLOWING RESPONSIBILITIES AND CONDITIONS. RECEIPT OF ANY PAYMENT INDICATES YOUR ACKNOWLEDGEMENT AND ACCEPTANCE OF THE TERMS STATED BELOW.

By signing this release, I fully understand and agree that $200.00 is non-refundable and that my “Reserved Trip Credit” is also a “credit” for any future BCG trip and non-refundable. I also agree and fully comply that if I cancel my trip 60 to 90 days prior to arrival, a trip credit of 50% of the amount paid will be issued for a future trip. If cancellation notice is received 59 to 0 days prior to Arrival, 100% of the amount paid is NON–REFUNDABLE.

WAIVER ACKNOWLEDGEMENT:
To the best of my knowledge, I along with my partner, am in good physical condition and fully able to participate in The NYE Cruise 2024 and The Smokey Mountain Getaway February 21-24 of 2025. I am fully aware of the risks and hazards connected with the participation on this trip, including physical injury or even death, and hereby elect to voluntarily participate in said events, knowing that the associated physical activity may be hazardous to me and my property. I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OR LOSS, PROPERTY DAMAGE, OR PERSONAL INJURY, INCLUDING DEATH, that may be sustained by me, or loss or damage to property owned by me, as a result of participation in this “weekend getaway” event. I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE, The Black Couple Getaways (Black Love Homecoming L.L.C.). or project, their officers, servants, agents, and employees (hereinafter referred to as RELEASES) from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in physical activity, or while on or upon the premises where the event is being conducted. It is my expressed intent that this is a release and hold harmless agreement which shall bind the members of my family and spouse, if I am alive, and my heirs, assigns and personal representative, if I am deceased, and shall be deemed as a RELEASE, WAIVE, DISCHARGE, and CONVENTION TO SUE The Black Couple Getaways and above named RELEASES. I hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be constructed in accordance with the laws of the State of Georgia

RESPONSIBILITY and RELEASE:
This document gives notice that The Urban Professionals Inc. does not own or operate any motor coaches, aircraft, cruise lines, catering facilities, hotels or attractions and that all arrangements have been made with motor coach companies, hotels, and other independent suppliers to provide you with the services purchased in the trip upon the express condition that we shall not be liable for any injury, accident, loss, damage, delay, bankruptcy, or any irregularity which may occur either by reason of defect in any vehicle or through the acts of default of any person or company engaged in providing transportation or other services. The Urban Professionals Inc. does not accept any liability for the actions or omissions of these independent suppliers over whom The Urban Professionals Inc. has no direct control. In the absence of negligence on The Black Couple Getaways part, therefore EACH PARTICIPANT HEREBY RELEASES The Urban Professionals Inc. for losses or damages arising from physical or emotional injury, property damages, or other economic damage caused by such factors beyond The Urban Professionals Inc.’s control. Because of unforeseen circumstances, The Black Couple Getaways reserve the right to withdraw any trip or make any change, with or without notice, In the event of inclement weather, mechanical difficulties, or other events beyond the control of The Black Couple Getaways. that cause delays, It SHALL NOT BE the responsibility of The Black Couple Getaways to pay for resulting costs and expenses to the group or trip client, including additional lodging and meals. Furthermore, It SHALL NOT BE the responsibility of Black Couple Getaways to reimburse the group or trip client for trip inclusions missed resulting from such delay.

OPTIONAL ACTIVITIES:
Optional activities are offered as advertised unless weather or other conditions make it impossible for individuals to participate. Payment for optional activities must be made in cash at the location. The Urban Professionals Inc. assumes no risk, liability, or responsibility for incidents or accidents which may occur to an individual while participating in any activity. Many activities are subject to a minimum participation as dictated by the operator and available transportation. Prices for all optional activities are subject to change with or without notice. THIS TRIP IS GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF GEORGIA. In the unlikely event a dispute cannot be amicably resolved, and a court action is necessary, it is agreed that all disputes and demands shall be heard in Fulton County, Georgia

CANCELLATION and REFUND POLICY:
If a reservation is canceled, the right to receive a refund is limited to all funds minus the $200.00 non-refundable deposit provided you are not within 90 days out of the trip. This does not include paying for a “Reserved Trip Slot” which is considered a “CREDIT”. Late fees and finance charges are non-refundable. I also agree and fully comply that if I cancel my trip 60 to 90 days prior to arrival, a trip credit of 50% of the amount paid will be issued for a future trip. If a cancellation notice is received 59 to 0 days prior to arrival, 100% of the amount paid is NON–REFUNDABLE. You are agreeing to this with your electronic signature on this registration. Any person and bank or financial institution returning non-refundable money back to our consumer will be sued for violation of the agreement set forth between our client and company. All cancellations are subject to loss of the initial deposit unless canceling within 90 days prior to trip departure, in which case, it would be subject to a 50% or 100% cancellation fee depending on cancel date. Remaining occupants in the room shall be obligated to pay for the difference in the per-person room rate. All monies from a canceled guest are non-transferable to another guest, no matter their relationship. Written notification via email must be sent by the person whom paid to request a refund of their unused monies. Refund(s) will be sent to the original payee and are made on the specific condition that the acceptance of the refund releases BLACK COUPLE GETAWAYS (Black Love Homecoming LLC). from all present or future claims by the participant. Reservations cannot be confirmed unless secured by the timely arrival of required deposits and final payments and rooming lists due to The Black Couple Getaways no later than 90 days prior. Reservations not paid in full shall be placed on a “space available basis” and are subject to cancellation policy regardless of alternative tour options that may be offered.

LATE FEES and FINANCE FEES:
If you agree to the installment plan you agree to stay on the agreed upon installment schedule along with any fees associated, primarily financing fees. Finance and late payment fees are non-refundable. There will be a $25.00 “late fee” assessed for all late payments after the payment is fifteen (15) days past due to everyone agreeing to these “terms and conditions”. Any trip not paid off in full by the final payment date will be subject to cancellation or at best at $25.00 late fee. If a reservation is canceled, the right to receive a refund is limited to all funds minus the $200.00 non-refundable minus finance fees if any, along with the deposit, provided you are not within 90 days of the trip. All cancellations are subject to loss of the initial deposit again along with any finance fee associated with the account unless canceling within 60 days prior to trip departure, in which case, the registrant would be subject to 100% cancellation fee. I also agree and fully comply that if I cancel my trip 60 to 90 days days prior to arrival, a trip credit of 50% of the amount paid will be issued for a future trip. If a cancellation notice is received 59 to 0 days prior to arrival, 100% of the amount paid is NON–REFUNDABLE. You agree to this with your electronic signature.

REINSTATEMENT FEE:
If your trip is canceled for lack of payment, missed installment payments, family emergency, work emergency or anything beyond your control, there will be a $75.00 “reinstatement fee” assessed to “reclaim your trip” again within the stated time frame.

RESERVATIONS, DEPOSITS AND PAYMENTS:
Deposits and final balances with rooming list must be received by The Urban Professionals Inc. on or before the appropriate due dates of 60 days prior to the actual trip. Reservations for time and space cannot be confirmed unless secured by the timely arrival of these required deposits, final payments and rooming lists. Arrangements shall be made for reservations paid in full, on time and upon the timely receipt of the final rooming lists to The Black Couple Getaways.

NO REFUNDS FOR UNUSED SERVICES:
Refunds or allowances will not be made for transportation services, excursions or other portions of the trip which are unused before, on or after the tour departure date. Failure to provide flight or arrival information does not negate the non-refundable policy. In the event of an Act of God or inclement weather, Black Couple Getaways reserves to right to reschedule the trip for another time.

OPTIONAL ACTIVITIES, ENTERTAINMENT, AND ITINERARIES:
It is intended that all optional activities will be offered as listed on the web advertising the trip unless weather or other conditions prevail at that time that make it hazardous or impossible for individuals to participate in the activity. The Black Couple Getaways does not act as an agent or operate any optional activity. The decision to participate in an optional activity is solely between the trip participant and the operator of the optional activity. The Urban Professionals Inc. assumes no risk, liability, or responsibility for incidents or accidents which may occur to an individual while participating in the activity. Some optional activities are subject to a minimum participation requirement and may not be available at all due to inclement weather or other Acts of God. Payment for all optional activities must be made in cash ONLY. The Black Couple Getaways reserves the right to withdraw or change any contracted entertainer. The Urban Professionals Inc. will not provide reimbursement due to “no show” entertainers or change in itineraries. The destination hotels, transportation companies, in addition to all other providers of services, reserve the right to remove a person engaged in illegal or disorderly conduct from the tour without refund.

LEGAL AGE FOR CONSUMPTION OF ALCOHOLIC BEVERAGES:
There is no minimum age requirement to participate in most of these tours, however all trips offering an “Open Bar Weekend” have been designed for adults 21 years of age and older. Each trip participant must be of the minimum drinking age allowed by the State in which the destination is located to participate in the functions or tour inclusions which contain alcoholic beverages, AND EACH TRIP PARTICIPANT MUST BE PREPARED TO SHOW 2 TYPES OF LEGAL IDENTIFICATION (ONE OF WHICH MUST INCLUDE A PHOTOGRAPH) TO GAIN ADMITTANCE INTO ANY FUNCTIONS OR EVENTS WHICH SERVE ALCOHOLIC BEVERAGES. Each liquor licensee is under legal obligation to comply with all applicable laws. To that end, each liquor licensee is required by law to not serve alcoholic beverages to individuals who do not meet the standard of service, even though they may have paid for the alcoholic beverage inclusion as part of their tour.

ROOM ASSIGNMENTS:
Room assignments and decisions are made by the hotel personnel, not by our Black Couple Getaways. Per person, prices are stipulated by the number of people in the room, not the number of beds. Double occupancy (2 people per room) does not mean that the room has two double beds. Triple and Quad rooms WILL NOT have more than two beds per room.
